DMCA & Copyright Policy – Variety Vibes Radio

Variety Vibes Radio (“the Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects its users, artists, and contributors to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov, Variety Vibes Radio will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent.

This policy applies to all services provided by Variety Vibes Radio, including our website (www.varietyvibesradio.com), 24/7 online radio station, Roku and Firestick TV channels, and official mobile application.

1. Notice of Copyright Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our services by completing a DMCA Notice of Alleged Infringement (“Notice”) and delivering it to our Designated Copyright Agent.

Upon receipt of a valid Notice, Variety Vibes Radio will take whatever action, in its sole discretion, it deems appropriate, including the removal of the challenged content from our radio rotation, TV broadcast, or digital platforms.

Your Notice must include the following information:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by this Notice, a representative list of the copyrighted works that you claim have been infringed.
  2. Identification of the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific song title, artist name, video segment, or URL).
  3. Your contact information, including your full legal name, mailing address, telephone number, and, if available, email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

2. Counter-Notification Procedures

If you receive a notification that your content has been removed due to a copyright infringement complaint, and you believe the removal was a result of a mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent.

The Counter-Notification must include:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Variety Vibes Radio may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
  5. Your physical or electronic signature.

3. Repeat Infringer Policy

Variety Vibes Radio maintains a “repeat infringer” policy. We reserve the right to terminate the accounts of users, artists, or contributors, and to permanently cease the promotion and broadcasting of content from any individual or entity found to be repeatedly infringing the intellectual property rights of others.

5. Disclaimers

Variety Vibes Radio provides a platform for independent and established artists. While we facilitate exposure through radio airplay, TV broadcasting, and mobile app features, the responsibility for ensuring that all submitted content (including music, videos, and promotional materials) does not infringe upon third-party rights rests solely with the submitting party.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
